The unrelenting brutality of ICE and The Disappearance of Orbin Serrano A Minnesota Citizen
He is alive but ICE made sure No One Could Reach Him By Relocating Him To Teas
The Disappearance of Orbin Serrano
WHERE HE IS NOW (Current Status: Jan 21, 2026)
Location: ERO El Paso Camp East Montana (El Paso, Texas).
Condition: Critical/Neglected. Orbin is alive but reportedly suffering from severe internal pain.
Medical Alert: He has a pre-existing knee injury (from a recent surgery) that was likely re-injured during the takedown.
Treatment: According to his sister Consuelo, detention staff are only giving him “creams and pills” and have refused a professional examination of his knee or internal injuries.
Legal Status: A fundraising effort has raised $87,810 to retain counsel, but no release date has been set. He is being held on a reinstated removal order from 2020.
⏱️ THE FORENSIC TIMELINE
Incident Date: Sunday, January 11, 2026
Location: Speedway Gas Station, St. Paul, MN
Phase 1: The Stop & Escalation
The Approach: Plainclothes agents surround Orbin’s vehicle. DHS alleges he “refused to obey” orders to exit.
The Breach: Agents shatter the driver’s side window. Glass fragments cover the interior. Orbin is forcibly extracted from the vehicle.
Phase 2: The “Attempted Murder” Sequence
The Pin: Four federal agents immediately pin Orbin to the pavement.
The Choke: Video evidence suggests pressure was applied to his neck/upper body. Orbin stops moving entirely.
Loss of Consciousness: His body goes limp. The agents do not check for a pulse. They do not check his pupi do not call EMS.
Phase 3: The “Luggage” Carry
The Drag: Instead of rendering aid, agents pick him up by one leg and his neck, carrying his unconscious body like a piece of luggage toward an unmarked van.
The Transport: Footage captures the moment agents buckle his limp body into the van seat. His head is slumped completely forward, chin to chest. He is non-responsive.
Phase 4: The Disappearance (Jan 12–13)
The Silence: For over 24 hours, his family does not know if he is alive.
The Transfer: While the video goes viral in Minnesota, ICE quietly transports him 1,200 miles south to El Paso, Texas, effectively cutting him off from local legal aid during the critical 48-hour window.
⚖️ RIGHTS VIOLATIONS ANALYSIS
1. Excessive Force (Fourth Amendment)
The use of a chokehold or respiratory restriction on a subject who is not posing an immediate lethal threat is a violation of federal use-of-force policies.
Key Evidence: The “limp body” drag proves total incapacitation, yet force (carrying by the neck) continued.
2. Deliberate Indifference (Eighth Amendment)
Federal agents have a constitutional duty to provide medical care to persons in their custody.
Violation: Buckling an unconscious man into a seated position without verifying vital signs constitutes “deliberate indifference” to a serious medical need.
3. Due Process Interference
Rapidly transferring a detainee across state lines before they can contact counsel is a tactic used to disrupt legal defense strategies.
