But for residents watching the developments, the message is clear: do not hold your breath. Time and time again, DHS has proven they cannot be trusted.

Promises on Paper, But Not in Practice

During the meeting, federal representatives laid out their supposed blueprint for the facility. DHS confirmed it will be a processing center for single adults, expecting to take in roughly 250 individuals per week with a capped occupancy of 542 beds.

The agency made several commitments designed to placate an outraged community. They promised strict security measures, including a secure perimeter, 24/7 surveillance, and controlled access. They also outlined limited operations, pledging that there will be no detainees released directly into the Surprise community, no local immigration enforcement triggered by the facility, and absolutely no operations in sensitive areas like schools or churches. Furthermore, DHS agreed to reimburse the city for lost tax revenue and offset infrastructure costs.

However, residents and local leaders know these are empty assurances. As one speaker at the protest bluntly stated, “A memorandum of understanding is probably the most we can expect, and we all need to acknowledge that it is not legally enforceable.”

The moment these commitments become inconvenient for the federal government, they will vanish. The community is being told to trust an agency that failed to even notify the city before purchasing the land.

  1. DHS circumvented standard federal contracting transparency. To get the facility up and running at breakneck speed, the administration funneled detention funding through a Department of Defense and U.S. Navy procurement system. By using a military procurement system, the federal government bypassed the normal competitive bidding process required for most civilian federal contracts. They handed over a massive renovation contract without the usual public scrutiny.

  2. They weaponized the Supremacy Clause of the U.S. Constitution. DHS purchased a 400,000 square foot warehouse zoned strictly for light industrial use, which explicitly forbids human habitation. Because federal law supersedes state and municipal law, DHS can entirely ignore local zoning ordinances.

  3. They bypassed required environmental impact reviews. A facility of this scale places immense strain on local water resources, utilities, and emergency services. Yet, DHS acquired the site and pushed forward with retrofitting a commercial warehouse into a detention center without conducting the necessary environmental assessments or offering the city a chance to prepare.

No Light In The Dark Heart Of The Machine

The situation in Surprise is a textbook example of federal overreach. The government bought a massive warehouse right next to suburban neighborhoods, completely bypassing local oversight, standard procurement laws, and environmental regulations. Now, they are handing out nonbinding promises to a community they intentionally kept in the dark.

If their track record is any indication, these verbal agreements and unenforceable memorandums are nothing more than a smokescreen. The residents of Surprise are right to brace for broken promises.

This is the deportation machine treating communities as collateral damage while expanding its carceral footprint to process surplus labor and terrorize migrants. Keep eyes on ICE.
